Speaking With a Virginia Nursing Home Abuse Lawyer
When danger is immediate for someone living in a Virginia home, call 911 first. According to the state law on patient rights, Va. Under Code § 32.1-138, all licensed nursing homes must maintain policies that inform patients of their rights. Those policies must ensure patients may voice grievances free from reprisal. They must also keep patients free of mental and physical abuse, and of unauthorized chemical or physical restraints unless an emergency applies. In Virginia, the general injury filing deadline is 2 years, per Va. Code provisions §§ 8.01-228 et seq., but nursing home or medical claims can follow a different, sometimes shorter deadline. The family can have an attorney confirm the exact dates.
The provider information and health deficiencies files from CMS Care Compare supply the data.
