The CMS data files for nursing homes show that residents statewide get 3.67 hours of daily nursing care. Nationally, the average is 3.86 hours, and West Virginia falls short of that mark, ranking 45th. Across the state, 44.1% of nursing staff left within a year, against a nationwide figure of 45.8%. Statewide, 20.2% of all citations came out of complaint investigations. The largest single penalty imposed on a West Virginia home since September 2023 came in March 2024. Federal officials fined Wyoming Healthcare Center in New Richmond $268,733.

Speaking With a West Virginia Nursing Home Abuse Lawyer
When a West Virginia resident faces immediate danger, phone 911 first. The statute W. Va. Code § 9-6-9 makes an employee of a nursing home, a medical professional, or another covered person a mandatory reporter. That person must immediately report reasonable cause to believe that abuse, neglect, or financial exploitation of a resident is occurring. In West Virginia, the general injury filing deadline runs 2 years, and W. Va. law sets it. That deadline comes from Code §§ 55-2-1 et seq., although a different, sometimes shorter deadline can apply to a nursing home or medical claim. The family can have an attorney check the West Virginia dates.
