Low Nurse Staffing Across New York Nursing Homes
For daily nursing time, New York stands 46th nationwide: residents average 3.63 hours of nurse care each day, below the nation's 3.86-hour average. In CMS inspection files, 401 homes among 585 evaluated in the state said nursing time fell short of the level expected for residents' care needs; CMS is the federal Medicare agency. Across the state, annual nursing-staff turnover averages 40.3%, lower than the national rate of 45.8%.
Over New York's last three inspection cycles, inspectors logged 597 accident hazard and supervision citations. Resident harm or immediate danger appeared in 142. Infection prevention and control rules were the only category cited more often statewide, at 655 violations. Since September 2023, the state's largest single federal fine has been $460,490. The penalty went to Waterview Heights Rehabilitation and Nursing Center in Rochester and was issued in December 2025. New York has three homes in the Special Focus Facility program at the federal level for persistent inspection problems: Waterview Heights, Grand Manor Nursing & Rehabilitation Center, plus Van Duyn Center for Rehabilitation and Nursing.

New York Nursing Home Inspection Reports
On NYS Health Profiles: Nursing Homes, families can check complaint histories, quality measures, and inspection records from the state. The public database allows searches by enforcement action, service, facility name, or region. Medicare's Care Compare also carries a profile for every licensed home in New York, taking over from Nursing Home Compare as the federal search tool. Those federal profiles open inspection reports for every facility, called Form CMS-2567 deficiency statements. Those statements detail the 12,122 total citations inspectors recorded statewide during the last three cycles.
People worried about unsafe care may call 1-888-201-4563 or submit a state complaint online to the New York State Department of Health. Across the last three inspection cycles, complaint visits produced 27.0% of all citations from inspections statewide. The New York State Long Term Care Ombudsman Program is an advocacy office for residents, hosted by the New York State Office for the Aging. Families with day-to-day care disputes can call 1-855-582-6769.

Speaking With a New York Nursing Home Abuse Lawyer
When danger is immediate for a New York nursing home resident, call 911 before anything else. Under New York Civil Practice Under Laws & Rules §§ 201 et seq., 3 years is the state's general injury filing time limit; for nursing-home or medical claims, another deadline can apply, sometimes a shorter one. N.Y. Public Health Law § 2895-b also requires facilities to keep daily staffing at 3.5 care hours per resident. That total must include at least 2.2 hours from certified nurse aides and 1.1 hours from licensed nurses, with penalties for noncompliance. A lawyer can verify New York filing dates for the family.
The provider information and health deficiencies files from CMS Care Compare supply the data.
